Terms and Conditions
The following Terms and Conditions are standard in our proposals unless otherwise stated. Please contact us with any questions.
Proposals may be withdrawn if not accepted within 15 days. *If it is not mentioned in the proposal, it is not factored into the price. *Price includes all necessary material and labor, disposal of material, jobsite supervision, permitting, and cleaning up construction debris when complete. *All work performed will be up to the National Association of Home Builders Residential Construction Performance Guidelines. *Price does not include addressing any unforeseen issues such as water leaks, termite damage, wood rot, floor leveling issues, or any other unforeseen issue. *All ALLOWANCE amounts include taxes and freight charges. *A 25% markup will be included on all change orders. Additional Terms of Contract
1. JOB COMPLETION/WHEN PAYMENT DUE: Upon substantial completion, all outstanding balances shall become due and shall be paid in full within ten (10) days.
2. WORK QUALITY: All work shall be performed in a good and workmanlike manner per standard practices.
3. ADDITIONAL WORK: Any alteration or deviation from the above scope of work at Customer’s direction involving extra costs or additional work will become an extra charge over and above the price term.
4. EXCEPTIONS: Company will not be responsible for strikes, accidents, inclement weather, shortages of materials, acts of God, or other circumstances beyond its control that will cause price escalations and time extensions.
5. INSURANCE: Property owner or Primary Contractor shall be responsible for insurance on the real property and materials delivered at the job site.
6. ENFORCEMENT/COLLECTION: Should Customer fail to make any payment as required by this Company shall be entitled to proceed with its available legal remedies against Customer without further notice to Customer. Further, Customer shall reimburse Company for all reasonable attorney's fees and costs associated with collection of this account, plus interest on the unpaid balance in the amount of eighteen percent (18%) per annum or the maximum amount allowable by law, retroactive to thirty (30) days after the debt first became due.
7. ATTORNEY’S FEES/ VENUE SELECTION: In any litigation arising out of or relating to this Contract, the prevailing party shall recover all costs, including reasonable attorney’s fees. Further, this Contract shall be interpreted according to the laws of the State of Florida. Venue for any action arising out of or related to this Contract shall lie exclusively in the appropriate court located in Okaloosa County, Florida. Further, by signing this agreement, Customer hereby consents to be subject to personal jurisdiction of the State of Florida regarding any such litigation.
8. GARNISHMENT/WAIVER OF HEAD OF HOUSEHOLD: In the event of Customer’s breach of this Agreement, Customer hereby agrees that collection of any judgment obtained shall be subject to wage garnishment and Customer hereby waives any head of household exemption under Florida Statute 222.11(2)(b) and/or any other applicable Florida statute.
9. BINDING NATURE OF AGREEMENT/INTEGRATION CLAUSE: This agreement shall be binding upon the heirs, personal representative, successors and assigns of the parties. This agreement cannot be amended or altered except by a writing signed by both parties hereto. This is the sole agreement between the parties and supersedes all prior agreements between the parties; therefore, any representations, inducements, promises or agreements between the parties not contained in this Contract or a subsequent writing signed by the parties will not be enforceable.
10. WAIVER OF JURY TRIAL: If any litigation arises out of or relating to this Contract, Customer KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVES THE RIGHT TO A TRIAL BY JURY.
11. PERSONAL GUARANTY: By signing this agreement, the undersigned agrees to be personally responsible for payment and all other obligations under this agreement; this responsibility shall be joint and several with the responsibility of the contracting party (Customer) to this agreement.
ACCEPTANCE OF CONTRACT: The above prices, specifications, terms and conditions, including any attached pages incorporated herein are satisfactory and are hereby accepted. Company is authorized to proceed with the scope of work outlined above.
Payment will be made pursuant to the terms herein.
